1. Acceptance of Terms

By accessing or using emercintel.emerc.site (the "Platform"), operated by EMerc Enterprise ("we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

These Terms apply to all visitors, registered users, and anyone who accesses or uses the Platform in any capacity.

2. Description of Service

EMerc Intel is an automated cyber threat intelligence aggregation platform that collects, processes, and presents publicly available information relating to cybersecurity threats, vulnerabilities, data breaches, and technology news. The Platform uses artificial intelligence to summarise and categorise content sourced from third-party RSS feeds, government advisories, and public databases.

We do not generate original threat intelligence. All intelligence data is derived from publicly available sources including but not limited to NIST NVD, CISA, FIRST.org, and published news outlets.

It does not constitute professional cybersecurity advice, legal advice, or any other form of professional advice.

You should not rely solely on information from this Platform to make security decisions. Always consult qualified cybersecurity professionals before taking action based on threat intelligence data.

4. Acceptable Use

You agree to use the Platform only for lawful purposes. You must not:

  • โœ•Use threat intelligence data, IoC feeds, or STIX exports to conduct, plan, or facilitate any cyberattack or illegal activity
  • โœ•Attempt to reverse-engineer, scrape, or systematically harvest data from the Platform beyond normal use
  • โœ•Use the Platform in any way that violates applicable Nigerian, international, or local laws or regulations
  • โœ•Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • โœ•Submit false, misleading, or malicious content through any community features
  • โœ•Attempt to gain unauthorised access to any part of the Platform or its underlying systems
  • โœ•Use automated tools to overload, disrupt, or degrade the Platform's performance
  • โœ•Republish or commercialise AI-generated content from this Platform without written permission

5. IoC and Threat Data Usage

Indicators of Compromise (IoCs), STIX bundles, and threat feeds exported from this Platform are provided for defensive security purposes only. This includes use in security tools, SIEM platforms, firewall rules, and threat hunting operations for the purpose of protecting systems and networks.

Any use of exported IoC or threat data for offensive purposes, including but not limited to targeted attacks, network intrusion, or harassment, is strictly prohibited and may constitute a criminal offence under applicable law.

6. Third-Party Content and Attribution

This Platform aggregates content from third-party sources. We endeavour to attribute all sources and provide links to original content. We do not claim ownership of third-party content. Copyright remains with the original publishers.

CVE data is sourced from the NIST National Vulnerability Database (NVD). EPSS data is provided by FIRST.org. We are not affiliated with, endorsed by, or sponsored by NIST, CISA, MITRE, or FIRST.org.

7. AI-Generated Content

Article summaries, full stories, safety guides, correlation briefs, and hunt queries on this Platform are generated using artificial intelligence. While we aim for accuracy, AI-generated content may contain errors, omissions, or inaccuracies.

We make no warranty as to the accuracy, completeness, or timeliness of AI-generated content. Always verify critical security information with primary sources.

8. User Accounts

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must notify us immediately at emercintel@emerc.site of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms without notice.

9. Intellectual Property

The EMerc Intel platform, including its design, code, branding, AI systems, and original content, is the intellectual property of EMerc Enterprise. All rights reserved.

You may not copy, reproduce, distribute, or create derivative works from any part of this Platform without our express written permission.

10. Limitation of Liability

To the maximum extent permitted by applicable law, EMerc Enterprise and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of or inability to use the Platform, including but not limited to:

  • โ€”Security decisions made based on information from this Platform
  • โ€”Inaccuracies in AI-generated threat intelligence
  • โ€”Delays in publishing time-sensitive security information
  • โ€”Any cyberattack or security incident not prevented by acting on Platform data
  • โ€”Loss of data, business interruption, or financial losses

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or a prominent notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
